Maska Website Use Agreement

PLEASE READ THIS AGREEMENT CAREFULLY. IT GOVERNS YOUR USE OF THIS WEBSITE (THE "WEBSITE") OPERATED BY SPORT MASKA INC. ("MASKA"). EACH TIME YOU USE THE WEBSITE (INCLUDING BROWSING ITS PAGES, DOWNLOADING INFORMATION, OR PURCHASING PRODUCTS LISTED ON IT) YOU ACKNOWLEDGE AND SIGNIFY THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THIS AGREEMENT AS IT THEN READS. IF YOU DO NOT AGREE TO BE BOUND BY EACH PROVISION OF THIS AGREEMENT EACH TIME YOU USE THE WEBSITE, YOU MAY NOT USE THE WEBSITE.

•  Changes to this agreement

Maska may change, supplement or amend this Agreement as it relates to your future use of the Website from time to time, for any reason, and without any liability to you or any other person. In the event of such amendment, we will notify you by posting a revised Agreement on the Website and by indicating the date upon which the Agreement was last revised. In addition, we may send you an e-mail notice of the amended terms, if you have provided us with your e-mail address and if we are of the opinion that the amendments are substantial. Your continued use of the Website following either form of notice will signify your acceptance of the revised terms of the Agreement.

•  Ownership and permitted use of the website

The Website and all information (in text, graphical, video and audio forms), images, icons, software, design, applications and other elements available on or through the Website are the property of Maska, its Providers and others, and are protected by Canadian and international copyright, trade-mark, and other laws. Your use of the Website does not transfer to you any ownership or other rights in the Website or its content.

The Website may not be used for any purpose not expressly permitted by this Agreement. In particular, except as expressly stated otherwise in this Agreement, the Website may not be framed, copied, imitated, reproduced, republished, uploaded, posted, transmitted, modified, indexed, catalogued, mirrored or distributed in any way, in whole or in part, without the express prior written consent of Maska. You may not use any spiders, robots (bots) or automated tool of any kind to, directly or indirectly, collect any information from the Website. You may not use any of the software that is used in the operation of the Website except while you are using the Website. You may not reproduce, copy, duplicate, sell, or resell any part of the Website (including the software used in the operation of the Website) or access to the Website.

The Website is made available to you for your lawful use only. You may access and browse the Website using commercially available, SSL-capable Web browser software. You may print or download the pages of the Website for your personal use provided that you do not modify any of the Website pages or other content and you do not remove or alter any visible or non-visible identification, marks, notices, or disclaimers.

•  Misprints, errors, and product availability

Maska endeavours to provide current and accurate information on the Website. Nevertheless, misprints or other errors may occur. Accordingly, Maska reserves the right to change the prices of the goods and services advertised or offered for sale through the Website at any time and from time to time without any notice or liability to you or any other person. Also, Maska cannot guarantee that goods or services advertised or offered for sale on the Website will be available when ordered or thereafter. Maska reserves the right to limit quantities sold or available for sale. Nor does Maska warrant that product descriptions or other content of the Website are accurate, complete, reliable, current, or error-free. If a product offered by Maska on this Website is not as described, your sole remedy is to return it in unused condition. Finally, Maska reserves the right not to process orders (even accepted orders) where the price or other material information on the site is inaccurate.

•  Product information

All product sizes, measurements and attributes quoted are approximate. Sizing guides are provided to assist with your purchase and on occasion individual items may vary from published sizing guides. The apparel products are new, do not carry any product warranties and are provided as is. Use caution and a reputable service provider if you have your Jersey personalized or numbered. High heat methods used for personalization and numbering can damage the Jersey, cause shrinking and fade the color. We will not be responsible for any Jersey that has been personalized or numbered by you or an agent on your behalf.

•  Product colors

Every effort has been made to display product colors as accurately as possible. However, we cannot guarantee that actual product colors will be exactly as that displayed on your monitor as the colors you see depend on your computer monitor and settings. You may see some slight variations in color. We do not guarantee color fastness.

•  Disclaimer, limitation OF LIABILITY and indemnity

Maska strives to make your use of the Website a useful and enjoyable experience. Nevertheless, Maska and its service providers (the "Providers") do not accept any liability for your use of the Website. For that reason, the following provisions apply to your use of the Website:

THE OPERATION OF THE WEBSITE MAY BE AFFECTED BY NUMEROUS FACTORS BEYOND THE CONTROL OF MASKA AND MASKA AND ITS PROVIDERS DISCLAIM ANY AND ALL LIABILITY REGARDING SUCH MATTERS TO THE FULLEST EXTENT PERMITTED BY LAW.

•  Limitation of liability

MASKA AND ITS PROVIDERS WILL NOT UNDER ANY CIRCUMSTANCES BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY LOSS OF USE, LOSS OF PRODUCTION, LOSS OF INCOME OR PROFITS (ANTICIPATED OR OTHERWISE), LOSS OF MARKETS, ECONOMIC LOSS, SPECIAL, INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE OR PUNITIVE DAMAGES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), CIVIL LIABILITY OR UNDER ANY OTHER THEORY OF LAW OR EQUITY, ARISING FROM, CONNECTED WITH, OR RELATING TO THE USE OF THE WEBSITE BY YOU OR ANY OTHER PERSON, AND REGARDLESS OF ANY NEGLIGENCE OR OTHER FAULT OR WRONGDOING BY MASKA OR ANY PROVIDER OR ANY PERSON FOR WHOM MASKA OR ITS PROVIDERS ARE RESPONSIBLE, AND NOTWITHSTANDING THAT MASKA OR ITS PROVIDERS MAY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES BEING INCURRED BY YOU OR ANY OTHER PERSON.

•  Indemnity

YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS EACH OF MASKA AND ITS PROVIDERS AND ALL OF THEIR RESPECTIVE AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, INFORMATION PROVIDERS, SERVICE PROVIDERS, SUPPLIERS, LICENSORS AND LICENSEES, AND ALL OTHER RELATED, ASSOCIATED, OR CONNECTED PERSONS (COLLECTIVELY, THE "INDEMNIFIED PARTIES") FROM AND AGAINST ANY AND ALL LIABILITIES, EXPENSES AND COSTS, INCLUDING WITHOUT LIMITATION REASONABLE LEGAL FEES AND EXPENSES, INCURRED BY THE INDEMNIFIED PARTIES IN CONNECTION WITH ANY CLAIM OR DEMAND ARISING OUT OF, RELATED TO, OR CONNECTED WITH YOUR USE OF THE WEBSITE OR YOUR BREACH OF THIS AGREEMENT. YOU WILL ASSIST AND CO-OPERATE AS FULLY AS REASONABLY REQUIRED BY THE INDEMNIFIED PARTIES IN THE DEFENCE OF ANY SUCH CLAIM OR DEMAND. The exclusion of certain warranties and the limitation of certain liabilities are prohibited by legislation in some jurisdictions, hence the above limitations and exclusions may not apply to you.

The disclaimer, limitation of liability and indemnity provisions in this Agreement survive indefinitely after the termination of this Agreement.

Maska collects, uses, and discloses your personal information in accordance with the Privacy Policy, which is available by clicking here. Maska may change the Privacy Policy from time to time in its sole discretion.

•  Trade-mark information

CCM® is a registered trademark of CCM Holdings (1983) Inc. and is used under license by Sport Maska Inc., a subsidiary of Reebok-CCM Hockey, Inc. KOHO® is a registered trademarks of KHF Sports OY, a subsidiary of Reebok-CCM Hockey, Inc. JOFA® is a registered trademark of Jofa Holding AB, a subsidiary of Reebok-CCM Hockey, Inc. Pro Tacks and Vector are trademarks of Sport Maska Inc. NHL® is a registered trademark of the National Hockey League. Other product and company names and logos appearing on the Website may be registered or unregistered trade-names, trade-marks and service-marks of their respective owners.

Any use of the trade-names, trade-marks, service-marks and logos (collectively "Marks") displayed on the Website, except as expressly provided in this Agreement, is strictly prohibited. Nothing appearing on the Website or elsewhere shall be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any Marks displayed on the Website.

•  Other sites

The Website may include advertisements for, and links to, other Internet sites or resources and businesses operated by other persons (collectively "Other Sites"). Except for JOFA.com and KOHO.com, Other Sites are independent from Maska, and Maska has no responsibility or liability for or control over Other Sites, their business, goods, services, or content. Links to Other Sites are provided solely for your convenience. Your use of Other Sites and your dealings with the owners or operators of Other Sites is at your own risk, and you shall not make any claim against Maska arising out of your use of any Other Sites or your dealings with the owners or operators of any Other Sites. As between you and Maska, the provisions of this Agreement under the section headed Disclaimer, Limitation of Liability and Indemnity apply, with all necessary modifications, to your access to and use of any Other Sites and their business, goods, services, and content.

•  Linking, framing and mirroring the website

Links to the Website without the express written permission of Maska are strictly prohibited. To request permission to link to the Website, please contact info@reebokccm.com. Maska reserves the right to cancel and revoke any permission it may give to link to the Website at any time, for any reason, without any prior notice, and without any liability to you or any other person. The framing of the Website or any of its content in any form and by any method is strictly prohibited. The mirroring of the Website or any of its content in any form and by any method is strictly prohibited. You may not cause any advertisement including any pop-up or banner advertisement to appear at, or on, or after exiting, the Website.

•  Feedback and other UNSOLICITED submissions

We welcome your feedback and submissions. However, please note that any unsolicited feedback, comments, suggestions or ideas submitted by you to Maska (and all your intellectual property rights therein) shall become the property of Sport Maska Inc. You agree that feedback, comments or suggestions submitted by you do not violate any right of any third party including copyright, trademark, privacy or other personal or proprietary rights. You further agree that no feedback or material submitted by you shall be or contain libelous or otherwise unlawful, abusive or obscene material.

When you visit the Website or send e-mail to us, you are communicating with us electronically. You consent to receive communications from us electronically. We may communicate with you by e-mail or by posting notices on the Website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

•  Governing law and dispute resolution

This Agreement, your use of the Website, and all related matters are governed solely by the laws of Province of Québec, Canada and applicable federal laws of Canada, excluding any rules of private international law or the conflict of laws which would lead to the application of any other laws.
